These terms apply to every wholesale order placed with Corkys World LLC d/b/a Corkys Coffee, 2220 Gratiot Avenue, Detroit, Michigan ("Corky's"). You accept them when you apply for a wholesale account or place an order. CUPPA members also have a CUPPA Supply Agreement, which governs where the two differ.
1. Your account
Wholesale accounts are for businesses, approved by Corky's. Keep your business details, EIN and contacts accurate. Corky's may decline an application or close an account, and will fill any order already paid.
2. Pricing
Your price is the wholesale price shown in the store when you are signed in and place the order. Prices may change for future orders. Wholesale pricing is confidential.
3. Orders and payment
Order online and pay by card at checkout. Order minimums are shown in the store. No credit terms apply unless Corky's agrees to them in writing.
4. Sales tax
Corky's Direct accounts buy for resale. Send a valid resale or exemption certificate and your account is marked tax exempt; until then, sales tax is charged. Powered by Corky's accounts buy coffee for their own team, which is not for resale, so sales tax is charged where it applies.
5. Shipping
Coffee is roasted to order in Detroit and usually ships within seven (7) business days of payment. Limited releases and pre-orders ship complete on their release date. Title and risk pass to you on delivery. We ship within the United States.
6. Damage and shortages
Check your delivery and report any damage, shortage or error within seven (7) days, with photos, to wholesale@corkyscoffee.com. Corky's will replace or credit the affected items. Coffee is a food product, so opened or undamaged coffee cannot be returned.
7. Reselling (Corky's Direct)
You set your own resale prices. Sell Corky's coffee in its original, sealed packaging at your own shop, and on your own website for local pickup or delivery with Corky's written approval. Do not sell it on Amazon, eBay or other marketplaces, or to other resellers. Officially licensed coffees are made under license from the artists and estates: do not alter the packaging, and do not suggest an artist endorses your business. Powered by Corky's coffee is not for resale.
8. Our name and yours
You may use Corky's name and product images to promote the coffee you carry. Corky's may list your business in its store locator and as a place to find Corky's; ask us and we will remove it.
9. Product promise and limits
Corky's coffee is produced and packaged in line with food safety law and is fit for sale when it ships. If it is not, your remedy is replacement or a refund for the affected items. Corky's total liability for any order is limited to the amount paid for that order, and neither party is liable for indirect or lost-profit damages.
10. Changes and law
Corky's may update these terms for future orders by posting them at corkyscoffee.com/pages/wholesale-terms. Michigan law governs, and disputes go to the courts of Wayne County, Michigan. Questions: wholesale@corkyscoffee.com.
